This guidance relates to the equality and human rights aspects of the essential standards of quality and safety. It is primarily to support inspectors when monitoring compliance of health and adult social care services under the Health and Social Care Act 2008, but it will be useful for other CQC staff carrying out the regulation of health and social care providers, for example in registration, enforcement and methodology development. The guidance should be used flexibly to support day-to-day work, including: ensuring equality and human rights information is collected and analysed; using equality and human rights perspectives to help evaluate the impact on people using the service and therefore the level of concern; deciding on the equality and human rights content of regulatory, compliance or enforcement actions; and ensuring equality and human rights feature in review of compliance reports. Equality and human rights are considered in the context of: personalised care, treatment and support; safeguarding and safety; suitability of staffing; and the quality and suitability of management. The purpose of the document, and the related overview guidance on equality and human rights, are to provide support to inspectors when they are checking compliance, so they know what to look for and are clear about the role they have to play.
